What is the "Do Not Call" Registry (also called the Indian NDNC Registry)? The Indian "Do Not Call" Registry was formed by the Indian government on 12th October 2007 so that the telephone subscribers (Landline or mobile) can set their preference to opt-in or opt-out from receiving the unwanted telemarketing phone calls also called Unsolicited Commercial Communication (UCC). Within 45 days one should stop receiving these unwanted calls from more than 12,000 telemarketers who have been issued provisional registration. Registrations can be done either by calling or sending SMS with keywords "START DND" to "1909" from your phone, for de-registration send 'STOP DND'. If you still receive marketing calls, the mobile phone users can then complaint to their telecom service provider with the caller's details, time and phone number within 15 days. Fines start from Rs 500 to the service provider and then increases after repeated violation. Some government agencies are exempted. Is the NDNC Registry working? To some extent - Yes. Most of the friends I spoke with did see some improvement but they still continue receive these marketing calls every now and then. Experiences vary, some say they have hardly seen any impact while others have a better opinion. Most of them were receiving calls from banks and financial institutions. People are actually frustrated especially if they receive a call at an odd hour. Often these telemarketers do not even know the name of the person who they are calling. What could be the problem? (My thoughts and some web analysis) India has a huge population and due to cheap mobile services the number of mobile users has been increasing steadily. Neither the department of telecommunications nor the telecom service providers have enough staff to deal with this massive problem. The enforcement is clearly not working and hey this is India, not everything works per the rules anyway. It is also very common for big financial companies outsource their marketing to a third party call centers who then violate these rules. People in India tend to change phone numbers very frequently and keeping things in order with this high volums is also not easy. Many users who register a complain or email at helpline@ndncregistry.gov.in, do not always get a favourable response. Even if the government revokes the license of a telemarketing company, the owner may quickly setup a new company with a different name and registration, and the process starts all over again. What is Government planning to do about it? (Ref: www.indianexpress.com/story/343072.html) Well even the Indian Supreme court agrees that the "Do Not Call" registry is not working as designed and have asked the Union Government to explore the possibility to have a new list ('do-call' list) which will only have list of phone numbers of people willing to receive telemarketing calls. The good in this approach is that by default all phone numbers will be unsubscribed. In previous list all numbers were subscribed by default and you had to get your number removed from the list. Advocate Harsh Pathak, expressed his dissatisfaction that the Government had failed to arrest the menace of unsolicited calls. The court observed that cellphone users' fundamental right to privacy was being violated by some telemarketing companies. Many telemarketing companies take contracts with big financial institutions and get paid based on the calls made or the number of users they were able to signup, therefore many take their chances anyway. There have been proposals to increase the violation fee from Rs 500 to Rs 1000, let's see how far that goes. I feel that registration of a Telemarketing company should be made a bit more difficult and the licenses should be issued only after proper checks. I also feel that media should show more interest in these things and should catch some of these outfits red handed then broadcast it on TV. Conclusion: I hate telemarketing calls as much as anyone else. We should appreciate that atleast some steps have been taken in the right direction, without those the situation would have been much worse. It will take more time till all these rules are enforced properly and still there will always be some people who will not follow the rules anyway.
