Live-in relationships may be treated as marriage, India.BY: Bharat | Category: Relationships | Post Date: 2008-10-10
The proposal of Maharashtra state government to treat "Live-in" relationship as husband and wife has drawn criticism from most sections of Indian society. The girl will get the legal status of a wife and will enjoy all benefits of it. Have we finally decided to totally give up on our culture and the basic common sense a society should follow. I am not highly against a girl and boy living together or having an affair, but to give a word of legality is so not right. The whole concept of "Live-in" is non binding feeling between tho adults based on their own wish and risk. A quick background Maharashtra government had approved the proposal on October 8, based on recommendations of the Justice Mallimath Committee which said if a man and a woman are living together as husband and wife for a "reasonably long period", the man shall be deemed to have married the woman according to customary rights of either party. OK . what is now a "reasonably long period" .. 1 month .. 6 months or 1 year ? (nothing has been defined yet) Issues surrounding legalising the Live-in relationships "Live-in" relationships are a personal "non-binding" choice of a boy and a girl ( or man and a woman), now where does the state government get the right to interfere in these things. Live-in relationships should be left alone and let the two adults decide whether or not they should marry. I can already see several problems associated with it, the biggest being that there is no pre-written official proof that these two partners are actually in a relationship. What is a person has 3 different live-in relationship for 3 years, will you consider the previous two relationships as divorce. Then, we will soon be the number one country in terms of marriage and divorce rate, beating even America and Europe way behind. What if someone is already married and is just having an extra martial affair, now does he has two wives. What if an unmarried businessman has a secret affair with two different girls in different cities without their knowledge, will he now have two wives. If a live-in relationship couple decides to move out of Maharashtra state do they now suddenly lose their married status? If a girl and boy are paying guests in the same house, still having an affair, will you still consider them as husband and wife? This will additionally give another reason for couples not to marry who would have married otherwise. But what if they have a heated discussion and one of them says, "Thats it .. I am moving out". In a legalised marriage, couples feel responsible and they still feel responsible and obligated to continue with the relationship. What if a boy and a girl are just sharing an apartment and are not necessarily dating, if one of them wins a lottery, won't the other person try to claim that they were actually a husband and wife to get some reward of the lottery money. People who are supporting idea ask - What will happen if a girl gets pregnant, will the child be treated fairly buy our society. What will be the kid's last name. Who will take the responsibility of child if they decide to go for new boy friend and girl friend. If they are granted all rights of a married couple, it will be a headache for insurance companies and other agencies to accept or deny their joint request for an insurance application. Whats so difficult about marriage - Two witnesses + Signatures of the man and the woman = marriage. Are we in a way making prostitution both women and men as legal. Personal Conclusion In NO WAY a live-in relationship should be treated as marriage. The legal lawsuits claiming whether or not a couple is in Live-in relationship or not ( or in past) will also likely rise.
